Terms and Conditions for the "Make it Bearable" Influencer Competition
1. Eligibility: 1.1. The "Make it Bearable" Influencer Competition ("Competition") is open to individuals who:
- Are residents of Australia.
- Are at least 18 years of age.
- Have a minimum of 3,000 followers on a public Instagram, TikTok, or YouTube account. 1.2. Employees, agents, and affiliates of Bearable and their immediate family members are not eligible to participate.
2. How to Enter: 2.1. To enter the Competition, influencers must:
- Register their details via the landing page at https://bearable.shop/pages/makeitbearablewin
- Provide accurate and complete information, including social media handles for verification. 2.2. Upon successful registration, entrants will be notified via email or Instagram if they are selected to participate. 2.3. Selected influencers will receive a free Bearable back scratcher, which must be featured in their Competition entry video.
3. Entry Requirements: 3.1. Influencers must create a video (15-30 seconds) showcasing their funniest, most awkward, or "unbearable" moment using the Bearable back scratcher. 3.2. The video must be posted on Instagram, TikTok, or YouTube Shorts within 2 weeks of receiving the product. 3.3. The post must:
- Tag @BearableShop.
- Include the hashtag #MakeItBearable.
- Invite @BearableShop to collaborate on the post. 3.4. Entrants must also submit the video directly to Bearable via email at bearable.site@gmail.com or another method specified by Bearable. 3.5. By participating, entrants authorise Bearable to use their video for marketing purposes, including but not limited to social media, website content, digital ads, and any other promotional activities.
4. Competition Period: 4.1. The Competition begins on 28/10/24 and ends on 29/11/24 4.2. All entries must be submitted within 2 weeks of receiving the Bearable product. Late entries will not be considered.
5. Judging Criteria and Prize: 5.1. All eligible entries will be reviewed by a panel of judges appointed by Bearable. 5.2. The winner will be chosen based on creativity, originality, and engagement (likes, comments, shares) of the video. 5.3. The winner will receive a cash prize of $5,000 AUD. 5.4. The influencer whose unique discount code is used the most by their followers will receive an additional reward (details to be provided upon selection).
6. Notification of Winners: 6.1. The winner will be notified via email or Instagram within 14 days after the end of the Competition period. 6.2. If the winner does not respond within 7 days of notification, Bearable reserves the right to select an alternate winner.
7. Use of Content and Intellectual Property: 7.1. By entering the Competition, influencers grant Bearable a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, and display their entry for marketing and promotional purposes. 7.2. Entrants must submit their video directly to Bearable and agree that their content may be used across various marketing platforms, including but not limited to social media, website content, digital ads, and printed materials. 7.3. Entrants represent and warrant that their submissions are original works and do not infringe on the intellectual property rights of any third party.
8. Privacy: 8.1. Personal information collected during the registration process will be used to administer the Competition and will not be shared with third parties except as necessary for this purpose. 8.2. Entrants consent to Bearable using their name, image, and video in promotional material related to the Competition.
9. General Conditions: 9.1. Bearable reserves the right to cancel, suspend, or modify the Competition or any part of it, without notice, for any reason. 9.2. Bearable reserves the right to disqualify any entrant who violates these Terms and Conditions or engages in fraudulent activity. 9.3. Bearable is not responsible for lost, late, incomplete, or misdirected entries or for any technical failures that may limit an individual's ability to participate in the Competition.
10. Limitation of Liability: 10.1. By entering the Competition, entrants agree to release and hold harmless Bearable, its employees, agents, and affiliates from any claims or damages arising out of participation in the Competition or acceptance of any prize.
11. Governing Law: 11.1. These Terms and Conditions are governed by the laws of Australia. Any disputes arising out of the Competition will be subject to the exclusive jurisdiction of the courts of Australia.
12. Acceptance of Terms: 12.1. By participating in the Competition, entrants agree to abide by these Terms and Conditions.
